Core Trading, LLC and its affiliates (“CTA Options and Core Trading Associates“) operate this website (“Website“) to provide online access to information about CTA Options and its products and Services (as defined herein). By accessing and using this Website, you agree to each of the terms and conditions set forth herein (“Terms of Service” or “TOS“). CTA Options reserves the right to amend, remove, or add to the TOS at any time. Such modifications shall be effective immediately. CTA Options publishes information that is educational in nature and designed to contribute to your overall understanding of various types of technical analysis and how we apply this information to the financial markets. We are in no way recommending the purchase, sale or short sale of any securities, options, futures, or other financial instruments. This is very straight forward. The ideas within the trade room are for education purposes only. CTA Options instructors operate as independent contractors for the company.
Understanding Trading Risks
Electronic trading may not be suitable for everyone. This activity may result in the loss of more than 100% of an investment, which is the sole responsibility of the customer. The student should familiarize themselves with the use of margin and levered products before engaging in electronic trading. Your trades are your trades and your trades alone.
Confidentiality & Breach of Contract:
As a member of any of the chat rooms, trade rooms or educational programs you agree not to post or share information shared with you. This means no screenshots, recording and no posting on any forum or online without consent. You may not resell any trading documents, video content or otherwise without consent of Core Trading, llc.. Your membership may not be transferred to another party. Please note we track IP records for users who enter our private member sections and allow two IP’s per user to prevent sharing of log ins. We hold a zero tolerance policy on the above, please be advised.
Access to the CTA Trade Room:
In order to participate in the Trade Room, you will need to register for an account. You agree to: (a) create only one (1) account, which you may not share with anyone else; (b) provide accurate, truthful, current and complete information when creating your account; (c) maintain and promptly update your account information; (d) maintain the security of your account by not sharing your password with others and restricting access to your account and your computer.
The CTA Trade Room is governed by United States law. Although persons in other countries are welcome to participate in the Trade Room, the topics and discussion are intended for use by persons in the United States.
By creating an account and participating in the Trade Room, you affirm that you are at least 18 years of age and fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms of Use, and to abide by and comply with these Terms of Use. If any of your information changes, you agree to update your registration information as soon as possible.
Your invitation to participate in the Trade Room is personal and non-transferable. If you register with us, you agree to be responsible for any activities that occur under your account or password, and you agree you will not sell or otherwise transfer your membership or any membership rights, and you hereby release Core Trading, llc from any and all liability that may arise in connection with your participation in the Trade Room. We may refuse to grant to you, and you may not use, a screen name or email address that is already being used by someone else, impersonates another person, belongs to another person (without that person’s prior consent), violates the intellectual property or other rights of any person, is offensive for any reason, or that we reject for any other reason at our sole discretion. You may have only one screen name. You are responsible for maintaining the confidentiality of your password, and you will be held liable for all activities that occur under your screen name. You will notify Core Trading, llc if your member name or password has been lost, stolen, or used by another person. If you become aware of any unauthorized use of your password or of your account, you agree to notify Core Trading, llc immediately at support@ctaoptions.com
Even though the Trade Room is only open to authorized members, it should not be deemed a confidential Trade Room. Therefore, do not post or otherwise make available anything you would not want others to see in public. Also note that other members of the Trade Room can follow, communicate or connect with you once you start participating in the Trade Room, so your profile and what you say and what you post will be disclosed to others and we have no control over how other participants in the Trade Room will use the information you post or otherwise make available to the Trade Room.
Postings on the Core Trading Associates Trade Room:
Due to the interactive nature of postings on the Trade Room portion of the CTA Options Website, we are unable to assume responsibility for any of the materials posted by users. The ideas, suggestions, opinions, comments, and observations made by users, and any text, data, files, avatars, designs, contest submissions, photographs, images, likenesses, video, music, sound, voice recordings, chat, messages, files, biographical information or other material posted (all of which are referred to as “Postings”) are not endorsed by Core Trading, llc, CTA Options, Core Trading Associates, instructors, members or employees of the company, and we make no guarantee regarding the reliability, accuracy, or quality of any Posting. Your Posting may be available for all other users to view and download.
You acknowledge that you will evaluate and bear any risks related to your use of any Posting, including any reliance on the accuracy, completeness, or usefulness of such Posting. All Postings to the Trade Room are the sole responsibility of the person who originally posted the Posting, and your sole recourse for any damage you may suffer as a result of Postings shall be to such individual. You shall be solely responsible for your own Postings and the consequences of posting or publishing them. You also understand and acknowledge that: (a) the Trade Room has wide access to ideas and other materials and that many ideas may be similar or identical to your submission (your Posting) and/or each other; (b) you will not be entitled to any compensation as a result of Core Trading, llc use of any such similar or identical material, except as specifically set forth in rules or other documents that govern certain aspects of your use of the Trade Room and/or Core Trading, llc Website; and (c) Core Trading, llc does not now and will not have in the future any duty or liability, direct or indirect, vicarious, contributory, or otherwise, with respect to the infringement or protection of your copyright in and to your Posting. You agree that your Posting be treated as non-confidential and non-proprietary and will not be returned. You agree that you either: (i) own the rights to the Posting you submit and the right to grant all of the rights and licenses in these Terms of Use; or (ii) you have all necessary rights and licenses from the owner(s) of these rights to enter into these Terms of Use and grant Core Trading, llc the license above. Upon Core Trading, llc request, you will furnish Core Trading, llc any documentation, substantiation or releases necessary to verify your compliance with these Terms of Use.
By submitting the Postings to the Trade Room, you hereby grant Core Trading, llc a worldwide, irrevocable, non-exclusive, perpetual, royalty-free, sub licensable, and transferable right and license to use, reproduce, distribute, prepare derivative works of, display, and perform the Postings in connection with the Trade Room and/or Core Trading, llc Website and Core Trading, llc (and its successor’s) business, including without limitation for promoting and redistributing part or all of the Trade Room and/or Core Trading, llc Website (and derivative works thereof) in any media now known or hereafter developed, and may grant additional ownership or other rights as set forth in additional rules or other documents that govern certain aspects of your use of the Trade Room and/or Core Trading, llc Website. You authorize Core Trading, llc to publish your Posting in a searchable format that may be accessed by users of the Trade Room and/or Core Trading, llc Website. Except as prohibited by law, you waive any moral rights you may have in any Posting you submit, even if such Posting is altered or changed in a manner not agreeable to you.
You further perpetually and irrevocably grant Core Trading, llc the unconditional right to use, disseminate and display your name, persona and likeness included in any Posting and in connection with any Posting without any obligation or payment to you.
You agree that Core Trading, llc has no obligation to monitor or enforce your intellectual property rights to your Postings but has the right to protect and enforce its rights to use your Postings. You further acknowledge and agree that Core Trading, llc will not have any obligation to you with regard to Postings and that Core Trading, llc may or may not monitor, display or accept your Postings and may delete them at any time and you may have no right to access or control any Postings that you provide once you provide it.
Limitation of Liability:
TO THE MAXIMUM EXTENT ALLOWED BY LAW, YOU EXPRESSLY UNDERSTAND AND AGREE THAT COMPANY SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (A) THE USE OR THE INABILITY TO USE THE WEBSITE, ANY CONTENT, WIDGETS OR ANY PRODUCTS OR SERVICES PURCHASED VIA THE WEBSITE; (B) THE COST OF PROCUREMENT OF SUBSTITUTE PRODUCTS AND SERVICES RESULTING FROM ANY PRODUCTS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE WEBSITE OR OTHERWISE; (C) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS, CONTENT OR DATA; OR (D) ANY OTHER MATTER RELATING TO THE WEBSITE, ANY CONTENT, WIDGETS OR THE PURCHASE OF COMPANY’S PRODUCTS OR SERVICES. IF YOU ARE DISSATISFIED WITH THE WEBSITE, YOUR SOLE AND EXCLUSIVE REMEDY SHALL BE TO DISCONTINUE USE OF THE WEBSITE AND TERMINATE THIS AGREEMENT IN ACCORDANCE WITH ITS TERMS. TO THE MAXIMUM EXTENT ALLOWED BY LAW, IN NO EVENT SHALL COMPANY’S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT (INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE) OR OTHERWISE) EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE WEBSITE, WIDGETS, OR PURCHASING ANY CONTENT OR PURCHASING COMPANY’S SERVICES OR CORE TRADING, LLC ANY AMOUNT RETAINED BY COMPANY FROM YOU FOR PROVIDING THE SERVICE.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. ALL TOS, LICENSING AND OTHER ARE SUBJECT TO THE LAWS OF THE STATE OF KANSAS.
Indemnification:
You agree to indemnify, defend and hold harmless Company, and its officers, directors, employees, agents, members, information providers and suppliers from and against all claims, causes of action, suits, losses, expenses, damages and costs, including reasonable attorney’s fees, arising out of, in connection with or relating to any violation by you of the Subscription Agreement or these Terms of Use, including claims of infringement of intellectual property or other third party rights, or otherwise, directly or indirectly resulting from or attributable in any way to any access to, use of or posting of material or content on the Company site by you.
